Was ist nur los - bewirkt der Widerspruch zur Datennutzung im Regelfall eine Kündigung?

Es ist nun zum dritten Mal in Folge passiert. Da widerspricht man der Datennutzung für Werbezwecke und fordert eine Bestätigung. Als Bestätigung erhält man jedoch eine Bestätigung zur Kündigung des Vertrags.
Was ist denn da los? Ist das gängige Praxis? Ist dies überhaupt mit dem gültigen Recht vereinbar?
